Our Agency:
Richardson & Wrench Noosa Holidays (RWNH) act as the Agent of the Owner of the Property and accept reservations in that capacity in accordance with these Terms and Conditions. RWNH is not responsible for any misdescription of the Property. The Property may change and the Tariff may alter before this reservation commences. If the Property is sold, withdrawn from letting or becomes unavailable for any reason before this reservation commences, RWNH will use its best endeavours to assist you to find an alternate reservation at a similar tariff.

This Reservation:
To confirm this reservation you must pay the Holding Deposit when booking and the balance Deposit by the date specified. Your Deposit is non-refundable.
The balance Tariff is payable by not later than seven (7) days BEFORE the Arrival Date. If the Arrival Date is between 15 December and 15 January, the balance Tariff is payable by not later than one (1) month BEFORE the Arrival Date.
If you fail to pay the Holding Deposit or the balance Deposit or the balance Tariff strictly in accordance with this Condition:-
(a) this reservation will be cancelled;
(b) you agree that:-
(i) any Deposit paid will be forfeited by you to the Owner of the Property to compensate the Owner of the Property for the loss of this reservation; and
(ii) any unpaid Deposit is a debt due and payable by you to the Owner of the Property.

Cancellations:
Any cancellation of this reservation by you must be notified to RWNH by facsimile or email or other writing sent by registered post.
1. If you cancel this reservation up to and including 30 days before the Arrival Date, 20% (twenty percent) of the deposit paid plus an additional administration fee of $330 will be forfeited by you. 2. If you cancel this reservation less than 30 days before the Arrival Date, you agree that any Deposit paid:- (a) Will NOT be refunded to you; (b) MAY in the absolute discretion of the Owner of the property be refunded in part (less the administration fee of $330) if the Property is re-booked for a reservation identical in all respects to this reservation.

Building, Renovations:
No responsibility is taken for any noise disturbance due to building, renovations and construction works being carried out in Noosa.

Force Majeure:
If circumstances beyond the control of RWNH affect this reservation (such as flood, fire, act of God, war or threat of war, physical unrest, riots, civil disturbances, terrorist activities (threatened or actual), strikes, port or airport closure, technical problems with transport, alteration or cancellation of scheduled travel services) then RWNH may, at its discretion, cancel this reservation and offer either:-
(a) alternate accommodation; or
(b) a proportional refund of monies paid by the Guest.

Insurance:
RWNH recommends that the Guest insure against loss of deposit, cancellation charges, medical expenses and loss of personal belongings and any other foreseeable loss or expense.

Check-in:
Check-in is required on the Arrival Date from 2.00pm onwards. Upon check-in, the named Guest(s) must sign a Guest Registration Form, pay any balance Tariff and provide a signed credit card imprint. Any person who wishes to register as a Guest must complete a Guest Registration Form and provide a signed credit card imprint.

Keys:
The keys to the Property will be collected from and returned to RWNH at 23 Hastings Street, Noosa by not later than the Arrival Date and the check-out time (10.00am) on the Departure Date, respectively. If the keys are returned after checkout time on the Departure Date you agree to pay an additional daily tariff applicable to the Property. Any key, remote control or alarm device that is lost will be replaced at your cost.

Security deposit:
Upon check-in and prior to receiving the keys to the Property and in addition to the balance Tariff, the Guest(s) must sign a blank credit card imprint to be held by RWNH for the duration of this reservation and until thirty (30) days after the end of this reservation. Debit cards will not be accepted. The Guest(s) authorise RWNH to pay or reimburse itself or the Owner of the Property by debiting the credit card provided for any cost or expense, damage, breakage or other loss applicable to or arising out of the use and occupation of the Property pursuant to this reservation (including but not limited to telephone charges, hire and cleaning charges, the repair and/or reinstatement of the Property) and any cost or expense incurred due to the breach of these Terms and Conditions (including but not limited to, any charges incurred with or by RWNH, Police, Fire or other emergency services or security personnel) and any additional Tariff payable by the Guest(s). If the credit available on the credit card provided is insufficient to pay or reimburse the whole of the cost or expense and/or additional Tariff to RWNH or the Owner of the Property, the Guest(s) acknowledge their joint and several liability to pay to or reimburse RWNH or the Owner of the Property for any outstanding cost or expense.

Credit cards:
The balance Tariff, any additional Tariff and the lock and weir access key charge may be paid and the credit card imprint for the Security Deposit may be provided, by a credit card (VISA or MasterCard only) in the name of the Guest(s) and any other person who signs the Guest Registration Form upon check-in on the Arrival Date. Not more than two (2) credit card(s) will be accepted for any payment. Debit cards will not be accepted.

Use of the Property:
The Property is a residential dwelling within the Noosa community. The Property is to be used strictly as a residential dwelling for residential purposes by the Guest(s) and the number of occupants nominated on the Guest Registration Form. The Property is not to be used for any other purpose or by any greater number of occupants. The use of the Property for a function, a party or other like gathering is STRICTLY PROHIBITED. If you use the Property for a function, a party or other like gathering or other than as a residential dwelling for residential purposes:-
(a) your reservation of the Property will be terminated;
(b) the Guest(s) and other occupants of the Property will be removed from it;
(c) the Guest(s) agrees to pay an additional Tariff of $4,400 (incl GST) and authorise RWNH to debit that additional Tariff to the credit card(s) provided.

Internet connection:
The Property may have a broadband internet connection (wired or wireless). The operation of any internet connection during this reservation is not guaranteed and may be disrupted or not available. The cost of using any internet connection is not included in the Tariff. Neither the Owner of the Property or RWNH is responsible for or liable in respect of the availability or any disruption of, any internet connection or its use.

Gym equipment:
Use of gymnasium equipment in the Property (if any) by the Guest(s) or occupant(s) of, or visitors to, the Property, occurs solely at the risk of the person using that equipment. Neither the Owner of the Property or RWNH is responsible for or liable in respect of, any injury to the person or damage to the Property, resulting from that use.

Body Corporate by-laws:
The Guest(s) and all other occupants or visitors of the Property will comply with any Body Corporate by-laws and rules applicable to the Property or which regulate the behaviour of occupants of the Property. The Guest(s) and all other occupants and visitors of the Property will not create or permit any noise or other nuisance to occur within or emanate from the Property. Failure to comply with Body Corporate by-laws or rules or the creation or occurrence of noise or other nuisance in or from the Property, may result in the termination of this reservation of the Property and removal of the Guest(s) and other occupants from the Property.

Noosa Waters lock and weir:
If the Property is located within the Noosa Waters lock and weir system, a lock access card may be provided to the Guest. The cost of providing the lock access card ($600) will be debited to the Guest's credit card and will be refunded to the credit card by BPay within seven (7) days of the return of the card. If the card is lost or not returned at the end of this reservation you agree to pay $600 to replace the card and for that charge to be debited to the Guest credit card.

Personal belongings:
The Guest(s) is responsible to ensure that all personal belongings are removed from the Property at the end of this reservation. RWNH will use its best endeavours to locate the items reported by the Guest as left in the Property, when the Property is next vacant. Any items found will be returned COD at the Guest's expense to the Guest at the booking address.

Liability:
The Guest(s) is responsible and liable to reimburse the Owner of the Property for any damage to the Property, damage to or breakage of chattels or fixtures and fittings in the Property or any other loss suffered by the Owner as a consequence of the use or occupation of the Property during this reservation. Neither RWNH or the Owner of the Property is liable for any damage to or loss of property of or injury to, a Guest or other occupant, visitor or entrant to the Property. RWNH will use its best endeavours to arrange for the repair or replacement of any part of the Property that fails or misfunctions during this reservation. Neither RWNH or the Owner of the Property is liable for any such failure or misfunction.

Inspections:
If RWNH believes that these Terms and Conditions have been or are being breached, RWNH may inspect the Property at any time during this reservation upon demand and without notice. RWNH may inspect the Property at all other times during this reservation upon 24 hours verbal notice. Failure to provide required access to the Property may result in the termination of this reservation of the Property and removal of the Guest(s) and other occupants from the Property.

Termination:
If this reservation of the Property is terminated, RWNH and/or the Owner of the Property is authorised to do all things necessary to remove the Guest(s) and other occupants from the Property, at your cost. If this reservation of the Property is terminated and the Guest(s) and other occupants are removed from the Property, the Tariff applicable to the balance of this reservation will be forfeited to the Owner of the Property. There will be no refund of the Tariff.

Late arrivals:
RWNH office hours are 8.00am to 6.00pm daily except Public Holidays (9.00am to 5.00pm) and Christmas Day (closed). If you anticipate arriving outside of office hours, please contact us on 1800 066 672 to make alternative check-in arrangements. A security charge will be incurred for check-ins outside of office hours. The phone number for after-hours security is 0417 744 625. Allow at least thirty (30) minutes for after hours security to attend.

Cleaning and linen:
On your arrival the Property is presented with beds made up (excluding sofa beds and trundles). Linen is provided including bath towels (one per person). Beach towels are not provided. If you require additional linen or towels or services, please advise us before you check in, and these can be provided at your cost. Additional items are not provided. A small selection of travel size toiletries is provided. The Property is serviced mid-week (based on an eight (8) night plus reservation. The Property is a smoke free dwelling and must be kept clean and tidy and free of litter (including cigarette butts) at all times. The Property must be left clean and tidy at the end of this reservation. Any charges incurred to clean the Property when it is not left clean and tidy or to repair damage to or reinstate the Property, will be charged to the credit card(s) provided by way of security.

Car parking:
Some properties do not provide car parking. If car parking is provided the Guest(s) must only use the car parking space(s) allocated to the Property and not interfere with the use of common property by other persons.

Future reservations:
Reservations do not automatically repeat. If you wish to reserve the Property for another reservation you must make that reservation upon check-in or during this reservation. Usual reservation arrangements will apply.

Additional services:

Animals and birds:
No animal or bird will be brought to or kept in the Property. Any cleaning or pest treatment costs incurred as a result of an animal or bird being brought to or kept in the Property will be charged to the credit card(s) provided.

Pet Friendly Homes:
A small selection of RWNH holiday homes will accept pets. These homes are advertised on RWNH website under the heading PET FRIENDLY HOMES. Only those properties advertised within this section will accept pets – and with a maximum of two. These conditions will apply and these are found within our Terms and Conditions entitled ANIMALS AND BIRDS. Pets can only be brought to a property with the previous permission of RWNH. Thus, guests must advise in writing (email and/or fax) if they wish to bring their pet/s along with them during their stay. It must be stated the number and style of pet/s that will reside with them during their stay, for example a 8 kg dog named Fido. Guests will be asked to sign an additional addendum upon check in at 23 Hastings Street, Noosa Heads confirming that they accept that within their tariff a premium has been added to cover for a pest spray and carpet/upholstery clean. Any further damages/maintenance/cleaning/replacement of items that need to be attended to due to the pet/s residing at the property, will automatically be charged to the guests credit card within 30 (thirty) days from the Guests departure date. Examples of this may be scratched floors or damaged furnishings. Guests must ensure that the property is left in satisfactory condition after their departure and this is to include checking all garden/outside areas are clean and poop has been disposed of. Due to the maintenance that needs to be carried out after a Guest departure on a PET FRIENDLY HOME we are not able to offer Guests a later check out, normal check out of 10am will apply.

Governing Law:
The Law of Queensland governs your use and occupation of the Property during this reservation. You agree to submit to the exclusive jurisdiction of the Courts of Queensland.
